A: No, they are not.

The images in the Essentials by Carel Collections are original works and are Copyright©1998, Carel Lyn Ashzryl.

It should be acknowledged that some of the images do in fact have such a simplistic design that it would be virtually impossible to enforce the copyright on them, but the majority are fully protected under current copyright laws.

 Q: Why do I need to download the images?
   Why can't I just link to the images at your site?
A: Calling the images from my domain would increase the work load for the server that hosts it. This could potentially slow down access to the byCarel.com site which would then slow down the ability of visitors to your site being able to access the graphics from my site.

 Q: I'm using the graphics for a government,
   non-profit organization, commercial, personal
   or other web site. Do I need to provide a link
   to your site? A copyright notice? anything?
A: No, but a link is always appreciated. And, unless you are restricted from doing so, there's certainly no harm in providing a copyright notice for the graphics along with your other site information and/or copyright notices.

This answer assumes that you are not offering the graphics for use other than viewing from within your web site.

   or within my product. What do I need to do?
A: Well, take a look at the Essentials by Carel Collection Terms of Distribution.

 Q: What is 'Use other than Viewing'?
A: Use other than viewing refers to non-passive (active) use. This would be giving someone the ability to alter images, use them in design work, etc.

I do not consider using an image as part of the design of a web site to be offering the graphics for use other than viewing. The exception, of course, would be if you explicitly offer the graphics for download or use from your site.

In most cases, you will be considered to be offering the graphics for use other than viewing if you are granting another individual explicit or implied rights to download/access the images and 'use them as they please', 'use them for web site design', or use them for design purposes within or in conjunction with your product, etc.

 Q: I want to put your graphics in my archive
   or collection of graphics. Can I do that?
A: Absolutely not!

Although I do thank you for the compliment extended by your desire to include images from this site in your collection, I do not allow for this type of distribution.

If you are looking for graphics to distribute by such methods, I recommend searching for images that have explicitly been put in the public domain by the copyright holder.

If you like the graphics in this collection and want to make them available to other people, please just provide a link to this site from your archive site. Or, include the URL or a linking page on your cd or other media.

 Q: Why are your Terms of Use so long?
(Note: This is the most FAQ/complaint in the FAQ.)
A: Actually, compared to other license agreements, my terms are of a rather moderate size.

My terms are only long when compared to:
(This is fictional example and does not express or reflect any specific site's terms)
 'I picked these graphics up from various
 places. I think they're in the public domain.
 Feel free to use them, and be sure to give me
 a link.'

To answer to the question:

The Terms of Use are as long as they needed to be for the copyright holder to give users certain rights, to keep other rights, and to protect the rights of any third party properties used within the site.
